You have to be 21 years of age to purchase cannabis legal products in New York.
Shopping at a legal dispensary – like Verdi – guarantees the safety, quality, and transparency of the products and the shopping experience.Verdi is required (and regulated) to sell cannabis products that have been thoroughly tested for harmful substances and meet potency standards.
Additionally, buying from Verdi supports the legal cannabis industry, contributing to tax revenues which typically fund social services and other community resources.
On the other hand, illegal shops tend to sell untested products – which creates a sizeable health risk – and does not contribute anything to the community.
New York’s Marijuana Regulation and Taxation Act (MRTA), allows people over the age of 21 to consume cannabis anywhere that tobacco smoking is permitted. But there are still places where smoking cannabis is prohibited, including (but not limited to):
- In a workplace
- Inside a car
- On school property
- In places where tobacco smoking is already prohibited, such as bars, restaurants, offices, and certain public spaces.
Additionally, landlords may have certain rules prohibiting the use of cannabis on their property. Be sure you understand the rules of the specific location you’re in.
As of this writing, cannabis is illegal on the federal level – as well as in several states. If you plan on traveling with cannabis products, there are a few things to keep in mind.
Within State Boundaries: If you’re only traveling within a state where cannabis is legal, you can usually carry the legal amount allowed by that state.
Across State Lines: Due to cannabis being federally illegal, transporting cannabis across state lines is illegal, regardless of whether it’s legal in both states.
Air Travel: The Transportation Security Administration (TSA) is a federal agency. As cannabis is still illegal on the federal level, you cannot travel with it on a commercial flight, even if you’re traveling within or between states where it’s legal.
International Travel: It is illegal to travel internationally with cannabis products. Many other countries have laws strictly prohibiting cannabis – and even simple possession can lead to severe penalties.
Per the Marijuana Regulation and Taxation Act (MRTA), the tax structure involves several different levels of taxation:
Cultivation Tax: There is an imposed tax on the cultivation of cannabis at the rate of $1 per dry weight gram of cannabis flower, $0.25 per dry weight gram of cannabis trim, and $0.14 per gram of wet cannabis.
Potency Tax: Cannabis products are subjected to taxes based on their type and THC content. There is a 0.5 cent tax per milligram of THC for cannabis flower, a 0.8 cent tax per milligram for concentrated cannabis, and a 3 cent tax per milligram for edibles.
Local Tax: Municipalities are entitled to a 4% local tax on the sale of legal cannabis products. Of this 4%, 1% goes to the county and 3% goes to the municipality.
Tax revenue from legal cannabis is intended to go towards several initiatives, including public education, drug treatment and prevention programs, community reinvestment grants, and more.
